Stupendous Lettuce, LLC, and its respective subsidiaries, parents and affiliates (collectively, “Stupendous Lettuce”, “Company”, “we,”, “us,” or “our”) provides this Privacy Policy, including, without limitation, any policies, rules and other terms that are expressly incorporated herein by reference (collectively, this “Privacy Policy”) to describe how we collect, store, use, and share the personal information of each user of the Services (“you”, “your”, or the “user”) who (a) visits any of our websites that link to this Privacy Policy and/or the Terms of Service of which this Privacy Policy is a part (the “Terms of Service”), including our website located “www.getmixmix.com” as well as any other media form, media channel, web or mobile application or mobile website related or connected thereto (collectively, the “Sites”) and (b) content, information, functionality, products or services provided, available on or offered through the Sites, or services supplied by or on the behalf of us, regardless of how you access or use it, including services provided through the Sites and various tools to submit content and participate in managing your cannabis wholesale activities online and other services ((a) and (b) are referred to collectively herein as the “Services”). Please read this Privacy Policy carefully before using our Services.

By accessing, browsing, or otherwise using the Services, you agree to our collection, storage, use and disclosure of your information, as described in this Privacy Policy and the Terms of Service. All updates to this Privacy Policy are noted at the top of this page, with time-date reference for your convenience. This Privacy policy may change from time to time and Stupendous Lettuce reserves the right in its sole discretion to amend this Privacy Policy at any time. Your continued use of the Services after we make changes is deemed to be acceptance of those changes, so please check the Privacy Policy periodically for updates. This Privacy Policy applies to information we collect through the Sites as well as any of our other websites that post this Privacy Policy. This Privacy Policy does not apply to websites that post different privacy policies or statements.

Please Note: The Services may also provide access to or make available links through the Sites that direct you away from the Services to outside third-party websites, platforms, services, resources, products, entities or licensed retail locations (collectively, “Third Party Service Providers”). This Privacy Policy does not address the privacy or information collection, use, disclosure and/or retention practices of any thirty-party, including our Third Party Service Providers. Moreover, the privacy and information practices of such Third Party Service Providers do not apply to Stupendous Lettuce. Please review any applicable third-party entity’s own privacy and information practices. Stupendous Lettuce has no liability with respect to the use or misuse of personal information by such third-party entities or any failure to comply with such third-party entities’ privacy policies.

What is Personal Information?

For the purposes of this Privacy Policy, “Personal Information” means information that identifies, relates to, describes, is capable of being associated with, or could be linked, directly, or indirectly, with a particular individual or household. Personal information does not include publicly available information. We do not consider Personal Information to include information that has been aggregated or de-identified so that it does not allow a thirty party to easily identify a specific individual.

Privacy of Children

Our Services are not intended for persons under the age of 21. Children or persons under the age of 21 are not allowed to use our Sites or Services. If we learn or have reason to suspect that a user is under age 21, we will promptly deactivate that user’s account (“User Account”) and delete any personal information collected in connection therewith. Information We Collect and How We Collect It

Information You Provide Us

When you use our Services, we may collect information that you provide such as Business Information and Personal Information (collectively, “Information”) when you create a User Account, utilize the Services, and communicate, contact us or opt in by registering on our Sites and/or registering to receive alerts or other information via email, text, instant message, or phone.

Business Information. By using the Services, you agree to give us access to information and data about your company’s licensed medical and/or recreational cannabis operations, including, but not limited to inventory or any cannabis-related inventory data from seed to harvest to distribution and sale, customer and product transaction information, proof of licensure, as well as other operational, logistical and sales information; and you may also provide us access to your business’ s login to any required state or other governmental traceability system to the extent required by applicable law, together with usernames, passwords and any relevant permissions for that account (collectively, “Business Information”). When you provide use with your Business Information, you grant us and our service providers the right to use, reproduce, modify, perform, display, distribute or otherwise disclose to third parties or our affiliates of such material. This information is collected by Stupendous Lettuce in order to help us develop and offer our new products and services (which may be offered by Stupendous Lettuce or by a third party), improve our existing products and services, conduct due diligence and to comply with recordkeeping requirements relating to the sale of cannabis or cannabis-related products. You represent that you have access to this Business Information lawfully, and give us permission to access and share it, and you agree to comply with the terms, conditions, guidelines and policies of the applicable state traceability system. Should you provide us with your state system information, you are giving us access to your business name and contact information, along with your Business Information. If you choose to set up an account and choose to share your Business Information with other individuals and entities, we are not responsible for loss of confidentiality or any other consequences stemming from those actions. You main responsible for the use of any such account.

Personal Information. By using the Services, we may also collect business contact information necessary to provide our Services, such as when you set up an Organization Account via our wholesale portal (“Organization Account”) or individual User Accounts (collectively, “Accounts”). This information includes but is not limited to your‎ age, date of birth, state of residence, location information, email address, phone number, as well as other information, including demographic information such as gender, that you directly give us; and your company name, address, phone number, license number(s), employee name and email address, and other company details. We may also collect your retail customer’s information that you provide in order for us to provide the Services, such as‎ age, gender, email address, phone number, address, credit or debit card number, driver’s license or state-issued identification card, medical marijuana identification card, as well as other demographic information.

If you use our Services to visit Third Party Service Provider retail locations or pre-order product pickup or delivery through Stupendous Lettuce or our Third Party Service Providers, we may also collect personal information from your government identification card when you provide it to us, including your name, address, picture, driver license or other government identification card number, and any other information on your government identification card. You can choose not to provide certain information, but you may not be able to use all of the Service features as a result.

Information Automatically Collected

We or our third-party partners may automatically log information about you and your computer or mobile device when you access the Services. For example, when visiting our Sites, we may log your computer operating system type, browser type, IP address, geolocation information, referring website from which you accessed the Sites, pages you viewed on the Sites, how long you spent on a page on the Site, access times and information about your use of and actions on our Sites. We may collect device information about your mobile device that you use to access the Mobile App. We may collect analytics data, or use third-party analytics tools, to help us measure traffic and usage trends and to learn more about the demographics of our users. We will not collect any location information that you do not volunteer or enable. Our Third Party Service Providers or partners also may use data collection tools to compile reports collected through our Services with other information about your online activities over time, on other devices, and on other websites or apps, if those websites or apps also use the same Third Party Service Providers or partners. We will delete any location information that you request us to delete.

Log and Usage Data. Log and usage data is service-related, diagnostic, usage, and performance information our servers automatically collect when you access or use our Services and which we record in log files. Depending on how you interact with us, this log data may include your IP address, device information, browser type, and settings and information about your activity in the Services (such as the date/time stamps associated with your usage, pages and files viewed, searches, and other actions you take such as which features you use), device event information (such as system activity, error reports (sometimes called “crash dumps”), and hardware settings).

Device Data. We collect device data such as information about your computer, phone, tablet, or other device you use to access the Services. Depending on the device used, this device data may include information such as your IP address (or proxy server), device and application identification numbers, location, browser type, hardware model, Internet service provider and/or mobile carrier, operating system, and system configuration information.

Location Data. We collect location data such as information about your device’s location, which can be either precise or imprecise. How much information we collect depends on the type and settings of the device you use to access the Services. For example, we may use GPS and other technologies to collect geolocation data that tells us your current location (based on your IP address). You can opt out of allowing us to collect this information either by refusing access to the information or by disabling your location setting on your device. However, if you choose to opt out, you may not be able to use certain aspects of the Services.

From social media platforms and networks that you use in connection with our Services, or that share or allow you to share information with us, such as Facebook, Twitter, Pinterest, and Instagram. For example, if you use functionalities, plugins, widgets, or tools from social media platforms or networks in connection with our Services (e.g., to log into an account, or to share content with your friends and followers on social media), we will collect the information that you share with us, or that those social media platforms or networks share with us. Cookies and Similar Technologies. The Sites and other Services use cookies and similar technologies from time to time. A cookie is a small file of letters and numbers that we store on your browser or the hard drive of your computer. Cookies contain information that is transferred to your computer’s hard drive. For the purpose of this Privacy Policy, cookies and other similar technologies (like scripts, plugins, tags, device fingerprints, Local Stored Objects, beacons and pixels) are all called “cookies.” The following cookies are used on the Sites and the other Services:

  • Strictly necessary cookies. These are cookies that are required for the operation of the Sites and the other Services. They include, for example, cookies that enable you to pre-order or request product pickup or delivery through our Sites.
  • Analytical/performance cookies. They allow us to recognize and count the number of visitors and to see how visitors move around the Sites and the other Services when they are using the Sites and the other Services. This helps us to improve the way the Sites and the other Services work, for example, by ensuring that users are finding what they are looking for easily.

We will use this information to make the Sites, the other Services and any advertising which may be displayed on the Sites and the other Services more relevant to your interests. Digital Advertising & Analytics

We may partner with ad networks and other ad serving providers (“Advertising Providers”) that serve ads on behalf of us and others on non-affiliated platforms. Some of those ads may be personalized, meaning that they are intended to be relevant to you based on information Advertising Providers collect about your use of the Sites and the other Services and other sites or apps over time, including information about relationships among different browsers and devices. This type of advertising is known as interest-based advertising.

Stupendous Lettuce adheres to the Digital Advertising Alliance (“DAA”) Self-Regulatory Principles in connection with this interest-based advertising activity. You may visit the DAA Webchoices tool at www.aboutads.info to learn more about this type of advertising and how to opt out of this advertising on websites by companies participating in the DAA self-regulatory program. If you delete your cookies or use a different browser or mobile device, you may need to renew your opt-out choices exercised through the DAA Webchoices tool. How We Use Your Information

When you provide us with your Information, we may use your Information for any lawful purpose, including the following:

  • Improve our Services, functionality, and overall user experience;
  • Deliver our Services to you;
  • Better cater and market to our users, as well as learn about preferences and usage habits;
  • Respond to customer service requests, comments and questions;
  • Send periodic emails, notifications, and text messages regarding our Services;
  • Follow up with you after correspondence (live chat, email, or phone inquiries);
  • Communicate about our Third Party Service Providers and other partners’ products and services;
  • Automatically update the Mobile App on your device;
  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity; or prosecute those responsible for that activity;
  • Troubleshoot technical difficulties and errors;
  • Link or combine user information with other personal information;
  • For our legal compliance and to maintain the security of the Services;
  • As permitted or required by applicable law or regulatory requirements; and
  • For any additional purposes for which we have obtained your consent to the use or disclosure of your personal information.

Disclosure of Your Information

Except as disclosed in this Privacy Policy, we do not disclose your Information to any companies not part of Stupendous Lettuce or its parent, subsidiaries, affiliates, or related entities. In no event will we ever sell or rent any identifying Information, except in the form of aggregate consumer information, as described below. We may, however, share your Information as follows:

  • With third party vendors who process data on our behalf, such as e-mail service providers, texting platforms, and e-commerce providers.
  • With our partners, including distributors and dispensaries, that we provide products and services.
  • With other companies and brands owned or controlled by Stupendous Lettuce, including our subsidiaries and affiliates.
  • As part of a corporate sale, merger, or acquisition, or other transfer of all or part of our assets, including as part of a bankruptcy proceeding.
  • With our Advertising Providers and other third parties who engage in advertising, such as advertising networks, social media networks, or advertising/marketing companies.
  • Pursuant to a subpoena, court order, governmental inquiry, or other legal process, or to respond to lawful requests, or as otherwise required by law, or to protect the rights and property of Stupendous Lettuce, our agents, customers, or other third parties.
  • With your consent or as otherwise disclosed at the time of data collection or sharing.
  • We may share Information that has been de-identified or aggregated without limitation.
  • We may share Information for legal, protection and safety purposes, or in an emergency, which includes protecting the safety of our employees and agents, our customers, or others.
  • We may share Information for any other purpose disclosed by us when you provide the Information.

We may also share your Personal Information with our employees, contractors, consultants, affiliates and other parties who require such information to assist us with managing our relationship with you and the products and Services we provide, including trusted Third Party Service Provider or other third parties that provide services to us or on our behalf. For example, we may share your Personal Information from time to time with third-party information technology, data processing, and call center service providers so that we may operate our business.

  • Personal and online identifiers (such as first and last name, email address, or unique online identifiers);
  • Address, telephone number, driver’s license or state identification card number, credit card number, debit card number, or any other financial information, or medical information;

  • Commercial or transactions information (such as records of products or services purchased, obtained or considered);

  • Inferences drawn from the above information about your predicted characteristics and preferences; and

Finally, we may also sell, rent, or share aggregate consumer information (i.e., anonymized summary data) with others for their own uses. Specifically, if you register to use our Mobile App and create a User Account, we may sell, rent or share certain aggregate consumer information that we compile using personal information collected about you and other users. This aggregate consumer information will never include your name, phone number, email address, or mailing address. We may sell, rent or share this aggregate consumer information with our partners and other companies for their own marketing, product development, research, or other uses.

Do Not Track Signals

We honor do not track signals and do not track, plant cookies or use advertising when a Do Not Track (DNT) browser mechanism is in place.

Third-Party Links and Tools

The Sites and Services may include embedded web applications. These web applications are operated by third parties and may collect personal information about you on our behalf; however, we do not control the privacy practices of such applications and they are not covered by our Privacy Policy. In addition, the Services may provide links to third-party websites or apps. Such websites or apps are not covered by this Privacy Policy. You should review the privacy policies of other websites or apps that you use to learn about their information practices.

The Sites and the other Services may also include integrated social media tools or “plug-ins,” such as social networking tools offered by third parties. If you use these tools to share personal information or you otherwise interact with these features on the Sites and the other Services, those companies may collect information about you and may use and share such information in accordance with your account settings, including by sharing such information with the general public. Your interactions with third-party companies and your use of their features are governed by the privacy policies of the companies that provide those features. SMS/MMS Text Messages

Should you provide Stupendous Lettuce with your phone number and agree to receive SMS/MMS text messages sent by or on behalf of Stupendous Lettuce, including through the use of automatic dialing programs, you expressly consent to receiving such messages even in the event that your phone number is otherwise registered with a corporate, state, or national “Do Not Call” registry. Messaging and data rates may apply if you use this service. Please consult your service agreement with your wireless carrier or contact your wireless carrier to review your phone’s pricing plan and any charges for sending or receiving text messages. You acknowledge that you are responsible for messages, data or other charges that you incur by agreeing to receive text messages from Stupendous Lettuce. This service may not be available on all wireless carriers. Stupendous Lettuce may add or remove any wireless carrier from this service at any time without notice to you. Stupendous Lettuce is not responsible for any delays, failure of delivery, or errors in text messages. You also understand that you do not have to agree to receive SMS/MMS text messages from Stupendous Lettuce in order to utilize the Services and that your consent to being contacted is entirely voluntary. To unsubscribe from SMS text messages, reply to said SMS text messages with the word “STOP”.

International Transfers and Privacy Rights

Stupendous is based in and operates exclusively in the United States. If you are located in a jurisdiction outside the United States, the data protection laws in the United States may not be considered to provide an adequate level of protection under your local data protection laws. If you are a visitor to the Sites and prefer not to have your Personal Information transferred to the United States, do not access or use the Services. For transfers of Personal Information, we may base the transfer on appropriate safeguards, such as standard data protection clauses adopted by the European Commission or by a supervisory authority, approved code of conducts together with binding and enforceable commitments of the recipient, or approved certification mechanisms together with binding and enforceable commitments of the recipient. Dispensary Location/Finder Disclaimer

Should you decide to patronize a dispensary operated by one of our licensed Third Party Service Providers’ dispensaries, please be aware that we are not responsible for the collection or use of any information, including Personal Information, collected by such licensee. We encourage you to familiarize yourself with such licensee’s privacy policy because such policy, and not this Privacy Policy, shall apply.

Product Pickup and Delivery Disclaimer

Should you decide to patronize a product pickup or delivery service operated by a third party licensee, please be aware that we are not responsible for the collection or use of any information, including Personal Information, collected by such third party. We encourage you to familiarize yourself with such licensee’s privacy policy because such policy, and not this Privacy Policy, shall apply.

HIPAA

Stupendous Lettuce is not an entity that is covered by the Health Insurance Portability and Accountability Act (“HIPAA”). The HIPAA privacy rules apply generally to health plans, health care clearinghouses, and to health care providers. This means that the information that you provide to Stupendous Lettuce is not protected by the HIPAA privacy rules and regulations.

Rights to Your Information

You have the right to “opt in” and/or “opt out” of certain uses of your Information. Depending on your jurisdiction and applicable state consumer privacy laws, you may have additional choices about how we collect, use and share your Personal Information. With respect to the collection of your Personal Information, you may have rights to:

  • Request that we restrict, erase or delete some (or all) of your Personal Information in our possession subject to limitations related to certain security measures, anti-fraud policies and procedures and other obligations set forth herein;
  • Update or edit the Personal Information we have on file for you through your User Account or otherwise hold if its inaccurate or incomplete;

In the event you close your User Account, we will retain copies of your Personal Information if we believe it is reasonably necessary for us to do so due to our legal obligations, meet regulatory requirements, maintain security, prevent fraud and abuse, enforce our rights hereunder or the Terms of Service, or fulfill your requests related to your Personal Information including your requests to unsubscribe from our Services.

We will try to comply with your requests made pursuant to this Section as soon as is reasonably practicable. It is important to note, should you exercise your right to “opt out” as described herein, we may not be able to remove your Personal Information from the databases of the third parties or affiliates with whom we have already shared your Personal Information prior to the date of your request.

Your Rights as a California Resident Regarding Personal Information.

      Verification Process and Required Information. Note that we may need to request additional Information from you to verify your identity or understand the scope of your request, although you will not be required to create an Account with us to submit a request or have it fulfilled. We will require you to provide, at minimum, your full name and an email address or a mobile phone number.

      Authorized Agent. You may designate an authorized agent to make a CCPA request on your behalf by providing the authorized agent written permission to do so. We may require you to verify your own identity directly with us for requests to access or delete Personal Information.

      Non-Discrimination. We will not discriminate against you for exercising any of your privacy rights.
